Welcome to Primavera Clinic Brisbane (“we”, “us”, “our”, “our clinic”, “Primavera Clinic”). Primavera Clinic is bound by the Privacy Act 1988 (Cth) (Privacy Act). 

 

We are committed to protecting the privacy of our clients. This Privacy Policy outlines how our clients’ personal information is collected, handled and used within our clinic, and in what circumstances we may share it with third parties.

 

Why do we collect personal information?  

 

Our main purpose for collecting, using, holding and sharing your personal information is to offer and provide aesthetic and medical services and cosmetic products to you, our client, such as cosmetic injectable, dermal and skin laser therapy and related health care needs. We require your personal information to determine, manage and provide the appropriate cosmetic treatment and care plan.  

 

We also use it for directly related business activities, such as:

  • marketing and promotion of our clinic, services and products,

  • communicating with you regarding appointments, services and promotions,

  • facilitating the creation of and managing your online account with us, including registration on our website,

  • processing your order, supplying, providing, maintaining and improve our products and services

  • collecting and processing payments, 

  • sending invoices, 

  • reconciling transactions, 

  • practice audits and accreditation, 

  • staff training, 

  • improving our website and client experience,

  • complying with legal requirements and regulations.

 

At all times we try to limit the collection of personal information only to the information we reasonably need for the particular function or activity we are carrying out.

 

What personal information do we collect?

 

Primavera Clinic collects personal information which will be relevant to the clinical needs and treatment of the client, including sensitive information as it’s defined in the Privacy Act. When you register as a client of our clinic, you consent to our collection of your personal information, including your sensitive information. 

 

Specifically, we collect the following information about you:

 

  • name, date of birth, addresses, mobile and phone numbers, email address, social media handle, and other contact information,

  • gender, spoken languages,

  • medical information, including medical history, medications, allergies, adverse events, family history and risk factors, racial or ethnic origin (all of which constitutes sensitive information),

  • if applicable, Medicare number for identification and claiming purposes (which is also sensitive information),

  • when you register an online account on our website, your online account information, such as login credentials, usernames and passwords, password hints and similar security information,

  • photographs and video recordings before and after treatment, 

  • concerns, complications and post-treatment review,

  • payment and billing information (including card and bank information for transfers),

  • comments, feedback and other information you provide to us and any interactions with us.

When you browse our website or social media profile, we also collect the following information about you:

 

  • IP address and technical information (such as operating system, browser information),

  • information about your device, computer or network, referring domain and out link, search terms and pages visited on our website, date and time of access and browsing,  

  • geolocation if it is enabled on your device, 

  • purchase and viewing history,

  • service and product preferences.

 

How do we collect personal information?

 

You provide it to us.

Most personal information is collected directly from the client. We collect your personal information directly from you when you: 

  • book an appointment with us, 

  • register as a client of our clinic,

  • attend a consultation, treatment and post-treatment follow ups,

  • purchase our products or services,

  • register an online account with us,

  • interact with us over the phone, in person or online.

 

We collect it using IT resources.

We will also collect your personal information when you access our website, mobile application, social media, emails, online promotions and advertisements or browse for our services and products. We will use web analytics, cookies or similar technology, such as pixels, ad tags and tracking technologies. The collection of information will occur automatically and collected information will include:

 

  • computer, device, IP address and technical information to identify you and log your use, browser type and version, operating system and other software installed on your device, 

  • usage data, features and settings you used, URL stream data, purchase information and history, product and service preferences,

  • location information, geolocation, 

  • information recorded on our surveillance cameras if you are on or around our premises or facilities.

 

We receive it from third parties.

We may also collect our clients’ personal information from other sources, such as:

 

  • through referral from a client’s healthcare practitioner,

  • guardian or responsible person, 

  • IT service providers, advertising and marketing agents, data providers, third party websites and applications, such as social media platforms and networks.

Use of cookies

Our website uses cookies and similar tracking technologies to enhance your experience. You can choose to disable cookies through your browser settings, but this may affect your ability to use certain features of our website.

Online Activity

 

Analytics. Our website uses Google analytics and other analytics service to help us better understand visitor traffic, so we can improve our services. Although this data is mostly anonymous, it is possible that under certain circumstances, we may connect it to you.

 

Direct marketing. We may send you direct marketing communications and information about our services, opportunities, or events that we consider may be of interest to you if you have requested or consented to receive such communications. These communications may be sent in various forms, including mail, SMS, fax and email, in accordance with applicable marketing laws, such as the Australian Spam Act 2003 (Cth). You consent to us sending you those direct marketing communications by any of those methods. If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so.

 

You may opt-out of receiving our newsletters, promotional, marketing or other communications from us at any time by following the instructions to “unsubscribe' set out in the relevant communication and/or contacting us using the details set out in the “Contact us” section below. 

 

Sharing personal information with third parties

We will share your personal information with third parties if our dealings with you would reasonably require us to do so and where you would reasonably expect us to do so. 

 

We may share your information:

  • with service providers who perform services for us, such as payment processing, hosting our website servers, managing our IT systems and database,

  • with third parties who work with our practice for business purposes, such as accreditation agencies, professional advisors, including lawyers, accountants, and insurers, where necessary and appropriate,

  • with other healthcare providers and medical practitioners,

  • when it is required or authorised by law, such as under a court subpoena,

  • when it is necessary to lessen or prevent a serious threat to a client’s life, health or safety or public health or safety, or it is impractical to obtain the client’s consent,

  • when there is a legal requirement to share certain personal information.

 

If you have enquired about a specific cosmetic product, we may refer your personal information to our supplier to assist in providing information as to the suitability of the product for your needs.

 

We may engage external contractors to:

  • clean our premises; 

  • conduct clerical, mail-out, marketing and other tasks; and/or

  • provide temporary staff.

The use of such external contractors means that they may have access to the personal information stored in the database, or seen in our clinic.  We will, where practicable, require such contractors to agree to comply with the Privacy Act.

 

In addition, we may also use your personal information or disclose your personal information to IT marketing and advertising agencies in order to tailor the content of our promotions and emails to your needs and interests.

 

Disclosure outside Australia 

We do not disclose your personal information to overseas recipients. 

 

However, your personal information may be stored and processed in Australia, or another country where our service providers maintain servers and facilities. 

 

We take measures, including through contracts, to protect your personal information wherever it is located in a manner consistent with the standards of protection required under applicable privacy and data protection laws.

 

Google Analytics collects web traffic information when you visit our website. Google stores such information across multiple countries. When you use social network services such as Facebook or Instagram to communicate with us or to find our clinic, products and services, the social network provider and its partners may collect and hold your personal information overseas.

 

Disclosure of sensitive information

We only disclose your sensitive information for the purposes for which you gave it to us or for directly related purposes you would reasonably expect.

 

Anonymity

You do not have to provide us with your personal information. Where possible, we will give you the option to interact with us anonymously or by using a pseudonym, provided that it is lawful and practicable.

 

However, if you choose to deal with us in this way or choose not to provide us with your personal information, we may not be able to provide you with our services or otherwise interact with you.

 

Quality of personal information

We will take reasonable steps to ensure that the personal information we collect is accurate, up-to-date and complete. 

 

We periodically check the details within the information we hold with our clients.  

 

We encourage our clients to let us know if they become aware that the personal information we hold is inaccurate and we will respond promptly to any request for correction of data and will act quickly to correct any data that is found to be inaccurate.

 

Data Security

We may retain personal information we collect and keep in hard copy and/or electronically in our database.  Information will be retained, backed up and may be stored via “cloud”–based technology or on a hard drive.

 

We will take reasonable steps to ensure that the personal information that we hold about you is kept confidential and secure.

 

With regard to information kept electronically, we utilise a variety of security measures to maintain the safety of your personal information. These measures include:

  • encryption of sensitive data during transmission,

  • restricting access to your personal information to authorised personnel only,

  • using up-to-date virus software and prevention technology, password security and firewalls for our computer systems and websites, 

  • regularly updating our software to ensure the latest security updates are applied,

  • implementing IT and administrative internal policies and protocols and keep our IT service providers accountable.

 

With regard to information stored in hard copies, we keep your information safe by using physical measures, including barriers, locks, doors and security alarms at the premises where our business is located and putting in place company policies relating to behavior and security.

We take measures to restrict access to only personnel who need that personal information to effectively provide services to you.

 

Retention of personal information 

We will keep your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy and will not keep your personal information for longer than we need to. In most cases, this means that we will only retain your personal information for the duration of your relationship with us unless we are required to retain your personal information to comply with applicable laws, for example record-keeping obligations. Once we no longer need to or are required to retain your personal information, we will destroy it by securely erasing all personal information held digitally or in hard copies.

 

Accountability

It is the responsibility of all our employees to comply with privacy laws and this Privacy Policy. This Privacy Policy is made available to all current staff and new staff on induction.  Periodic training is also provided.

 

In addition, where commercially and legally practicable, we require external contractors to comply with privacy laws, the Privacy Act and our Privacy Policy.

 

Your rights

You have the right to request access to, and correction of, your personal information. Our clinic acknowledges clients may request access to their medical records. We require you to put this request in writing we will respond within 30 days. We will take reasonable steps to correct your personal information where the information is not accurate or up to date. 

 

You may also request that we correct or update your information. If you make a request, we must give you access to your personal information, and take reasonable steps to correct it if we consider it is incorrect, unless there is a law that allows or requires us not to. Please note that the access right is qualified. In some circumstances it may be lawful for us to refuse to give access to some or all the information we hold.

 

We may ask you provide addition information in order to verify your identity before we give you access to your information or correct it. 

 

If we decide to refuse to give you access to, or correct, your personal information, we will notify you in writing and provide the reasons for our decision. If we refuse to correct your personal information, you can request that we attach a statement which sets out what information you believe to be incorrect and why.

 

If we have disclosed the incorrect information to third parties, you can ask us to notify them about the correction. We must do so unless there is a valid reason not to.

We may require proof of your identity and full details of your request before we can process your complaint. 

We will acknowledge receipt of your complaint and will respond to it within 30 days. Once we receive a complaint from you, we will determine what (if any) action we should take to resolve the complaint. We may need to seek further information from you if we are to respond in a meaningful way. 

We encourage you to contact us with any concern regarding our use and handling of our personal information and we will use our best efforts to resolve such complaint to your satisfaction. It will not always be possible to resolve a complaint to everyone’s satisfaction.
