Service and Purchase Terms and Conditions

Welcome to Primavera Clinic. These Terms and Conditions (Terms) apply when you, our client, use our services, make a booking for a consultation or a treatment and/or
purchase products from Primavera Clinic, whether in person, by phone, through a booking engine, or on our website https://www.primaveraclinic.com.au/.
1. Application
(a) These Terms apply whenever you book and/or use our services (which include consultations and treatments) and/or make a purchase of products, goods and services from Primavera Clinic.
(b) You should read these Terms carefully before making a booking or purchase. You should not proceed with a booking or purchase if you do not agree to these Terms. By making a booking or purchase, accessing and/or using our services and products, you agree to be bound by these Terms.
(c) Primavera Clinic’s Privacy Policy https://www.primaveraclinic.com.au/privacy-policy and Website terms of use https://www.primaveraclinic.com.au/website-terms-of-use form part of these Terms. Please read them carefully.
(d) If you register an online account with us, on our website, the terms of use of the online account will apply as set out in Oline account terms of use.
(e) The following documents form part of your agreement with us:
i. These Terms,

v. any other policy or legal document found on our website or provided to you by Primavera Clinic, its doctors and therapists,
vi. any document explicitly incorporated by reference.
2. Treatments and bookings
(a) Primavera Clinic offers various cosmetic and aesthetic treatments.
(b) You can book your appointment through our website, by phone or in person at our clinic reception.
(c) All appointments must be booked in advance.
(d) Any cancellations or rescheduling of appointments must be done at least 48 hours in advance.
(e) You must read the Refund and Cancellation terms below (in Section 5 of this document) which set out your rights and obligations in case you wish to change or cancel your booking.
(f) You must book and complete an initial consultation before booking and undergoing any treatment.
(g) The initial consultation includes a full facial assessment, skin analysis and possible treatment options.
(h) The initial consultation’s fee is $150.00. The fee is payable at the time of making a booking of the initial consultation and is not refundable.
(i) When you make a booking, we will ask you to provide certain information about yourself and your needs. Collection of your personal information is subject to our
Privacy Policy https://www.primaveraclinic.com.au/privacy-policy which outlines our practices with respect to collection, handling, use and disclosure of your personal information, including sensitive
information, and applies to your use of our services, products, website, subscriptions, mobile applications, social media, online services, off-line services, in-person interactions and communications with you.
(j) You agree that you will be required to complete client consent forms and agree that there will be additional terms and conditions relating to specific treatments
before you receive relevant treatments.
(k) You must provide accurate, complete and current information to us to ensure we can find the most appropriate treatment for you.
(l) We will determine your eligibility for a specific treatment based on your medical history and current health.
(m) Individual treatment plans will be offered to each client based on their needs and our assessment.
(n) Following the initial consultation, we will provide an estimate of costs and time required for your treatment plan.
(o) Your booking is personal to you. You cannot transfer your treatments, once booked, to other individuals.
(p) All bookings are subject to confirmation and acceptance by Primavera Clinic.
Primavera Clinic may change or cancel any booking upon a reasonable notice to you. If Primavera Clinic changes or cancel your appointment, the consultation or
treatment fee paid by you will be applied towards the rescheduled appointment.
(q) Primavera Clinic reserves the right to:
a. refuse providing any treatment to any client with no liability to the client, subject to Refund and Cancellation terms,
b. decline or cancel further management of any client if, in the opinion of the medical practitioner the client’s condition is unsuitable for further care, and/or
c. cease the clinic-client relationship in our sole discretion at any time. In this case, we may suggest an alternative doctor or clinic to continue your treatments.
3. Booking time
(a) We will use our best efforts to deliver the relevant service at your booked time. However, we make no guarantee that we will be able to deliver the relevant service at your booked time. Occasionally, the doctors or therapists may be behind the schedule due to a number of factors.
(b) When making a booking, please take into consideration that your doctor or therapist could be running behind the schedule and that your appointment may be delayed.
(c) If you decide to leave Primavera Clinic due to a delay before your doctor or therapist consults with you, Primavera Clinic will not provide a refund for your treatment and reserves the right not to book you for future appointments.
4. Fees and Payments
(a) When you make a booking, you agree to pay the cost for services and/or goods
to Primavera Clinic in full, including any taxes and charges that may apply.
(b) The client must pay applicable fees to Primavera Clinic for every consultation and treatment unless the fee has been waived, partially or in full, by Primavera Clinic in its sole discretion.
(c) When booking a consultation and/or a treatment, you will be required to pay a full fee or a deposit of up to 50% of the applicable fee.
(d) Fees for consultations and treatments are payable in full before or at the time of receiving the service.
(e) Fees for treatments will be discussed with you at the time of your consultation.
(f) Fees and prices for certain treatments and products are specified on our website.
(g) Fees, details or prices for some cosmetic treatments involving prescription medicines are not disclosed on our website due to regulatory requirements.
(h) Fees and prices for treatments and products are subject to change without notice.
(i) You are not obliged to proceed with the treatment on the day for any reason. By booking the treatment, you agree to pay the fee applicable for the treatment. Our
Refund and Cancellation terms apply if you decide to not proceed with the treatment for any reason.
(j) We accept various payment methods, including credit and debit cards and cash.
(k) Payments made via Eftpos will not incur any processing fees. Payments made by American Express and Union Pay will incur a 1.65% surcharge, and Mastercard or VISA card will incur a 0.95% surcharge.
5. Refund and Cancellation terms
(a) A 48 hour change and cancellation notice applies to all appointments at Primavera Clinic. If you wish to cancel or reschedule your appointment, you must notify us at least 48 hours before your booked time.
(b) If you cancel or reschedule your appointment with less than 48 hours’ notice to us, or you are late to or do not attend your appointment, we will be entitled, in our sole discretion and at our choice, to do one of the following:
a. retain your deposit (if you have paid a deposit towards the applicable fee),
b. forfeit the prepaid fee,
c. forfeit the prepaid treatment or consultation,
d. charge you 50% of the applicable fee for your treatment or consultation (if you have not paid for it), or
e. charge you the full fee for your treatment or consultation (if you have not paid for it).
(c) If you attend your appointment and we are unable to perform the treatment:
a. due to your medical condition or medications, and/or
b. due to your failure to follow the pre-treatment care instructions, such as those set out in clause 7(h) of these Terms or any specific instructions provided on our website, by our doctor or therapist, we will exercise our rights under clause 5(b) of these Terms.
(d) If a client arrives late to their appointment, we reserve the right to not accept you for your appointment on that day. In this case, clause 5(b) will apply.
(e) We do not refund for change of mind.
(f) We will provide a refund if required by the Australian Consumer Law.
(g) We may exercise our discretion and provide a full or partial refund of the paid fee to you if we decide that the treatments purchased by you cannot be provided to
you due to your skin type or specific health condition, or if we decide that you may not be suitable for the treatment for any reason.
(h) If you pay in advance for a number of treatments (Package), refunds for the Package will not be provided unless required by the Australian Consumer Law.
6. Packages
(a) If you pre-pay for treatments, you will save an amount according to the pre- payment schedule.
(b) Pre‐paid treatments have a 12 month expiry date from the date of purchase.
(c) There is no refund for pre-paid treatments and they are not transferable to other individuals.
(d) On your therapist’s recommendation, you can change the purchased Package to another skin treatment Package which is no less in the value than the original Package, and subject to payment of the price difference. Non-medical beauty Packages cannot be transferred to medical (doctor only) treatments.
7. Client’s Responsibilities
(a) You must arrive to your appointment 15 minutes prior to your booked time.
(b) Clients must disclose all relevant medical history, family history, current health issues and any information which may be relevant to determine and perform a
treatment.
(c) Clients must follow all pre- and post-treatment care instructions provided on our website, by our doctors and therapists.
(d) It is the client’s responsibility to inform Primavera Clinic of any changes in their medical history (e.g., pregnancy, cold sores), medications (e.g., Roaccutane) and any relevant information about them.
(e) You must complete the registration and consent forms accurately and fully, and advise your treating doctor or therapist of any procedures or medications, either
oral or topical, that you are currently taking or have recently taken or used.
(f) The client is not permitted to record, share or publish virtual and in-person appointments with our doctors and therapists without prior consent of Primavera Clinic. All images, audio, and video are the property of Primavera Clinic.
(g) In the unlikely event of an emergency involving the care of the client, the client will be transported to a hospital at the discretion of the attending paramedics. All
costs related to the transfer and care of the client remain the responsibility of the client.
(h) Important for laser treatments: Clients scheduled for laser procedures should not have a current fake tan, recent sun exposure (within at least the last two weeks), active cold sores, or be currently taking Roaccutane.
8. Medical Disclaimers
(a) Our treatments and products may not be suitable for you. Whilst all due care and skill is exercised in treating our clients, it is your responsibility to determine if the
product or treatment is right for you.
(b) In order for us to provide you with a great service it is fundamental that you provide all information requested in completing consent forms or advise us of any factors that may affect your treatments. You also need to have reasonable expectations of the results of treatment. We encourage you to work with your therapist or doctor on what you can achieve with your treatment.
(c) You agree that the information we provide on our website and in our clinic is of a general nature and does not constitute professional medical or healthcare advice, diagnosis, or recommendation of a treatment. The information on the website and in the clinic is not intended to be and should not be used to replace professional medical advice. In no circumstances should any information be relied upon without independent consideration and confirmation by your doctor.
(d) Subject to the Australian Consumer Law, we make no representations or warranties with respect to any treatment, product and/or suitability or application
of a treatment or product or any specific result from a treatment or product.
Primavera Clinic offers no guarantee or warranty that any procedure will benefit the client or yield guaranteed outcomes. While every effort is made to achieve
desired outcomes, you, as the client, agree and acknowledge that these outcomes are not guaranteed. In no circumstances will we be liable for any direct, indirect, consequential, special, exemplary or other damages arising from or in connection with the offering and/or provision of a treatment or product, save for instances of fraud, negligence or professional misconduct.
(e) You must always seek advice of your doctor or other qualified medical practitioner about suitability of a treatment or product for you before undertaking and using a treatment or product.
9. Photography and video recordings
(a) Every client will have their photographs and/or video recordings taken before and after each treatment.
(b) By making an appointment at our clinic, you consent to us taking your photographs and/or video recordings and agree that this forms part of the protocol of the clinic. Photographs will be taken as and when advised by the doctor or therapist.
10. Feedback
(a) If you provide us with ideas, concepts, know-how, methodologies, comments, or suggestions relating to the website and our services and products (Feedback), you acknowledge and agree that:
i. all intellectual property rights in the Feedback, and anything created as a result of that Feedback (including new material, enhancements, modifications, or derivative works) vest in, and are owned solely by, us and you assign all intellectual property rights to us for that purpose, and
ii. we may publicly use or disclose the Feedback for any purpose.
11. Post Treatment Concerns
(a) A complimentary review will be offered for specific treatments requiring a post-treatment assessment between two to four weeks after the treatment.
(b) In the unlikely event that you experience a side effect, we will require a reasonable time and information to investigate your concern. Our doctors will determine whether or not your concern constitutes a side effect or medical complication.
(c) If you have any issues or concerns in relation to the treatment you have undergone, please call and/or send a message to the clinic at 0474 024 747 or
email primaveraclinicau@gmail.com. It is your responsibility to inform the clinic if there are any signs of infection, side effect or complication.
(d) Telehealth consultations are vital to determine how urgently you need to see a doctor. You must provide your full co-operation to enable us to assess and/or review your circumstances.
(e) You must call the emergency if your condition requires an immediate medical attention.
(f) All faces are asymmetrical. Our doctors, nurses and therapists will do their best to improve this. However, asymmetry is still common after a treatment has been
performed. All corrections of asymmetry post-treatment are at the cost of the сlient. We do not offer any complimentary treatments in the case of asymmetry.
12. Hyalase (dissolving the dermal filler)
(a) In case of a medical complication after a dermal filler, hyalase (ie dissolving of a dermal filler) is performed at the cost of the clinic.
(b) Our doctors will determine whether or not a client’s concern after a dermal filler is a medical complication.
(c) Should the client wish to dissolve any dermal fillers performed at Primavera Clinic, a minimum of four weeks after the procedure is required before assessment for suitability for hyalase, unless it is a medical emergency.
(d) The client must pay the cost of hyalase which does not constitute a medical complication. The cost of hyalase is around $650 per treatment, and you may require three or more treatments. You will be informed of the exact costs of hyalase and number of treatments required at the time of assessment.
(e) We reserve the right to decline the treatment of hyalase if we determine it to be unsafe, not in the client’s best interest, or if we wish to cease the clinic-client
relationship. In such cases, Primavera Clinic will refer the client to another clinic for further treatment.
13. Purchase of goods
(a) Primavera Clinic offers certain cosmetic and beauty goods for purchase in its clinic and through the website.
(b) Goods are sold subject to these terms to the exclusion of any other terms and conditions.
(c) All purchases of goods are final, subject to the warranty terms set out below. Primavera Clinic does not accept returns of goods for change of mind or incorrect purchase.
(d) The client warrants that the goods are purchased for personal use only and not in the course of a business.
(e) Before proceeding with the purchase, the client must satisfy itself as to the identification, content, quantity and price of goods to be purchased. The client warrants and acknowledges that the purchase is correct, accurate and complete.
(f) Goods must only be used for their intended purpose and in accordance with the relevant instructions, precautions, and guidelines. You are responsible for ensuring that the goods are suitable for you after seeking appropriate professional medical advice.
(g) You must check the ingredients for goods to avoid potential allergic reactions.
(h) If using prescription medications (oral or topical), pregnant, breastfeeding, or suffering from a specific health condition, you must seek advice from a medical practitioner or therapist before purchasing any goods from us.
(i) All prices are stated exclusive of any applicable duties, charges, levies, fees and taxes (including the GST), including delivery and shipping costs, unless stated otherwise.
(j) Upon sale of the goods and receipt of payment from the purchaser, Primavera Clinic will issue a receipt for the goods purchased. The client shall keep records of each purchase.
(k) The client must comply with any specification or instruction for the goods when using and storing the goods.
(l) Nothing in these terms shall be interpreted as an attempt to modify, limit or exclude terms or warranties which are imposed by statute (including but not limited to the Competition and Consumer Act 2010 (Cth)) and which cannot be modified, limited or excluded.
(m) Primavera Clinic warrants that the goods are of merchantable quality and free from defects.
(n) To the extent permitted by law, we give no warranty and make no representation, express or implied, as to the suitability, adequacy, or appropriateness of the goods for you or fitness of the goods for a particular purpose.
(o) Other than as specifically set out in these terms, and to the extent permitted by law, all representations and warranties implied by statute or law are excluded.
(p) Any claims relating to the quality of goods must be made within the warranty period applicable to those goods. Proof of purchase must be presented when a
warranty claim is made.
(q) The client can only return the goods if Primavera Clinic accepts that the goods are defective. The client shall contact our clinic if the client considers the goods
to be defective. The client shall not return any goods to Primavera Clinic unless Primavera Clinic confirms acceptance of a request for such return and provides any specific instructions for return of the goods.
14. Gift vouchers
(a) Gift vouchers are valid for 12 months from the date of purchase.
(b) Vouchers can be redeemed for purchase of any products and services in our clinic.
(c) Vouchers cannot be redeemed for the purchase of products and goods online.
(d) Vouchers are non-transferable and cannot be redeemed for cash.
(e) We do not provide refunds for change of mind or incorrect purchase.
(f) We may provide a refund solely in our discretion of if required by the Australian Consumer Law.
(g) No replacement vouchers will be issued if the voucher is lost or stolen. However, if details of purchased vouchers are retained in our point of sale system, the voucher may still be redeemed if lost or stolen, provided the correct client details were given at the time of purchase.
15. Limitation of liability
(a) Nothing in these Terms shall be interpreted as an attempt to modify, limit or exclude terms or warranties which are imposed by statute (including but not limited to the Competition and Consumer Act 2010 (Cth)) and which cannot be modified, limited or excluded.
(b) Other than as specifically set out in these Terms, and to the extent permissible by law, all representations and warranties implied by statute or law are excluded.
(c) To the extent permitted by law, the liability of Primavera Clinic for breach of these Terms, for negligence or other tort and for breach of statutory duty, implied term
or warranty about the services and products sold, shall be limited, at the option of Primavera Clinic, to:
in the case of the products which constitute goods:
a. the replacement of the goods;
b. the supply of equivalent goods; or
c. the payment of the cost of acquiring equivalent goods;
in the case of services:
d. the supplying of the services again; or
e. the payment of the cost of having the services supplied again.
(d) To the fullest extent permissible by law, we make no representations or warranties, express or implied, regarding any matter including fitness for a particular purpose or use in relation to any goods or services.
(e) You hereby acknowledge and agree that Primavera Clinic and its affiliates, officers, directors, employees and agents shall not be liable with respect to, and you hereby waive, release, and agree not to take action against any of them upon, any claim for any loss or harm suffered or incurred by you in connection with, arising out of, or in any way related to, the provision of our services, including an allergic reaction, except when it is caused by our fraud, negligence or wilful misconduct.
16. Governing Law
These Terms are governed by the laws of the Australian State or Territory in which you Primavera Clinic is located. By agreeing to these Terms, you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in that place.
17. Modification of Terms
(a) Primavera Clinic may revise these Terms at any time in its sole discretion by giving notice to the client and the revised terms will be immediately effective for all bookings and purchases made after such notice has been given to the client.
(b) This notice may be provided via email, SMS or a message on our website and/or your online account. Where the change materially and detrimentally affects your
rights and obligations under these Terms, you will be entitled to terminate these Terms by emailing primaveraclinicau@gmail.com
(c) If the client does not agree to the revised Terms, the client shall be entitled to terminate the clinic-client relationship with Primavera Clinic subject to the survival provisions and compliance with all provisions under then current Terms, including in relation to payment for the services and products, and the client is not obliged to make any new bookings and purchases. If the client chooses to continue using our goods and/or services following revision of the Terms, the client agrees to be bound by the revised Terms and the revised Terms will apply to all subsequent bookings and purchases.
